Declaration by President Costa on the occasion of World Human Rights Day and the 60th anniversary of the Universal Declaration of Human Rights

"The Declaration called into being most of the later international human rights protection instruments, and the European Convention on Human Rights, signed as early as 1950, directly follows the line it traced. The three regional human rights courts (African, European and Inter-American) have just held a major colloquy in the Human Rights Building, on 8 and 9 December, which provided an opportunity to compare case-law and practice."

In the case of S. and Marper v. the United Kingdom, the Court held that there had been a violation of Article 8 (right to respect for private and family life). The case concerns the storing, by the authorities, of fingerprints and DNA samples taken from the applicants in the context of unsuccessful criminal proceedings against them. 60th anniversary of the Universal Declaration of Human Rights

To mark the 60th anniversary of the Universal Declaration of Human Rights, a seminar entitled “Judicial Practices and Jurisprudential Policies” took place at the European Court of Human Rights on 8 and 9 December 2008, in cooperation with other regional human rights courts. The seminar was organised with the French Ministry of Foreign and European Affairs and the Strasbourg-based International Institute of Human Rights, in association with the African Foundation for International Law and the Inter-American Institute of Human Rights.

Visit from the President of the Moldovan Parliament

On 8 December 2008 President Costa welcomed Marian Lupu, President of the Moldovan Parliament, to the Court. Mihai Poalelungi, the judge elected in respect of Moldova, and Erik Fribergh, Registrar, was also present at this meeting.

Inadmissibility decision

22/12/2008

The Court declared inadmissible several applications against Italy lodged by, among others, individuals and associations whose members are relatives and friends of severely disabled persons.

 

The applicants complained of the adverse effects of the execution of a decision by the Italian courts authorising the discontinuation of the artificial nutrition and hydration of a woman who had been in a coma for almost 17 years. Press Release

 

Recent judgments

In the case of Aleksanyan v. Russia, the Court held in particular that there had been a violation of Article 3 (prohibition of inhuman or degrading treatment) on account of the lack of proper medical assistance in the remand prison. The applicant worked as the head of the legal department of Yukos. He alleged, in particular, that, in light of his medical condition, his detention amounted to inhuman and degrading treatment. In the case of TV Vest AS & Rogaland Pensjonistparti v. Norway the Court held that there had been a violation of Article 10 (freedom of expression) concerning a fine imposed on TV Vest for breaching Norway’s prohibition on television broadcasting of political advertisements. Press Release
